The space was most recently operated as a cafe' known as My Cousin's Place. The property is located in a Multifamily Residential/Local Services Subdistrict, where a take-out restaurant with total gross floor area not exceeding 1000 square feet is a conditional use in the basement and first story. Appellant proposes to continue to operate the space as a restaurant with take-out, serving sandwiches, coffee and gelato. The property is located in a Multifamily Residential Subdistrict. The zoning violation identified by ISD is Floor Area Ratio Excessive (North End District zoning code is 3.0.). Existing FAR (presumably pre-code) is 4.0. The proposal will add 627 square feet of living space, resulting in an FAR of 4.7. No units are being added to the existing 4-unit building.
